Cycle Hire Scheme User terms and conditions

1. In these terms and conditions some words have a special meaning as set out below:

a) Bike Access Period is a 90 minute time slot or part thereof that you wish to borrow a cycle for.

b) Bike or Cycle is a Bike Scheme bicycle.
c) Docking Station is the racking in combination with the locks provided to dock/undock the bikes.

d) Registered User is a person who has registered to use The Scheme by providing us with certain personal details via the website here  

e) Weour and us refers to easit and its associates.
f) You refers to a Registered User.

g)Web App refers to the web app that will give you access to the bikes by booking, unlocking and locking the bikes.

Bike Access Period

2. Our staff, contractors and agents have no authority to make individual exceptions or amendments to these terms and conditions.

2.1 All personal data about you will be processed in accordance with our Privacy Policy, which is available on our website www.easit.org.uk. 

2.2 We may amend these terms and conditions, from time to time. 

Registration

3. To register as a Registered User and use Cycle Hire, you must:

a) be aged 18 years or over;

b) To register you must be an employee or associate of one of the occupiers on The Heights Business Park and a member of the easitNETWORK where applicable.
c) ensure that all data provided by you is accurate;
d) advise us of the time, day and date and length of time that you would like to use the Bike for. 
e) agree to these terms and conditions.

3.1 We reserve the right to refuse your registration to Cycle Hire and use of a Cycle, in accordance with the provisions of our User Policy.

3.2 Your right to use Cycle Hire shall automatically expire at the end of the relevant Bike Access Period.

3.3 When the Period of use has expired: 
a) you will need to have returned the bike to the allocated Docking Station.

b) If you are unable to return the bike by the end of your Bike Access Period, you must notify us immediately of the request to extend at info@easit.org.uk

Web App

4. To access the Bike Scheme:

a) having registered, you will need to use the Web App to book, undock and dock the bike.
b) on unlocking the bike, you will be held responsible for said bike until it is docked and you have checked out.

Using the Bike

5. When using a Bike you must:
a) Be aged 18 years or over; and

b) comply with these terms and conditions and all applicable laws
c) check that the Bike (including, without limitation, the tyres, brakes, saddle and bell) is road worthy
d) abide by the Highway Code
e) observe all traffic signs and signals
f) use the Bike reasonably, considerately and responsibly
g) take reasonable care of the Bike

h) if using after dark affix suitable lights to the Bike, in accordance with the Highways Code.
i) when returning a Bike to a Docking Station, you must:

i) End your hire session via your Cycle Hire Account Here

ii) Securely dock and lock the Bike, at an available docking point. 

iii) Dock the Bike in the same condition as it was when undocked (except for fair wear and tear); and

You must not;

a) leave a Bike unattended during your period of hire.
b) use a Bike to provide or operate a courier service or other business
c) give, lend or sell the Bike to any other person or allow any other person to use a Bike.  
d) damage, deface or vandalise the Bike, Docking Station or any of our equipment or property in any way
e) load the:

Bike basket with a load of more than 10 kilograms or any object which overhangs the basket

Bike with a total weight of more than 115 kilograms

Bike with more than one person at a time or

Bike basket with any animals, children or persons

f) carry: 

Dangerous, hazardous or flammable substances or 

Any object that is: 

Likely to cause injury or offence to you or any other person 

Likely to cause damage to the Cycle, any other person or property or 

Prohibited at law 

g) use the Bike for racing or stunt or trick-riding
h) dismantle or tamper with the Bike (or in any way attempt to do so)
i) add or attach accessories or trailers to the Bike or 
j) use the Bike in an antisocial manner, i.e. a manner that causes or is likely to cause harassment, alarm or distress to others

6. If you experience any problem with a Bike during the Bike Access Period that prevents you from continuing to use the Bike or securely docking a Bike at an available Docking Point please contact info@easit.org.uk. If you experience any problem and are able to safely continue to use the Bike and return it to a Docking Station, please report the problem to us by emailing us at info@easit.org.uk

Period of Use and Extra Ride Charges

7. Bikes should not be used for more than 90 minutes (Maximum Period of Use).

7.1 You must return the Bike to a Docking Station and securely dock the Bike at a docking point prior to the expiry of the Maximum Period of Use.

7.2 The Period of Use for each Bike shall commence when you undock the Bike from a Docking Station and ends when you securely dock the Bike, and notify us of the bikes return to a Docking Station by clicking the Lock Button via Your Bike Hire Account

7.3 We reserve the right to prevent you from undocking a Bike from a Docking Station.

Availability of Cycle Hire

8. We will always try to run a reliable service. Sometimes part or all of Cycle Hire will be unable to operate for reasons beyond our reasonable control. We reserve the right to change the advertised dates and hours of operation of Cycle Hire without giving you prior notice.

8.1 During certain periods, Cycle Hire may be heavily used so we cannot always guarantee to have a:
a) Bike available for use at the Docking Station of your choice or
b) Docking point available to dock a Bike at the Docking Station of your choice

8.2 If you are unable to dock a Bike(s) at the Docking Station of your choice due to the lack of an available Docking Point(s), you should:
a) dock the Bike(s) at one of the alternative Docking Stations. 

Your obligations

9. You are personally responsible for:
a) each Bike that you use.
b) all items that you transport on a Bike or in the Bike basket

9.1 From time to time, we may require information in respect of use of a Bike by you. At our request, you agree to provide:
a) your name and address and
b) details of each journey, including the date and time that you used a Bike and route taken

10. While using a Bike, you must comply with these terms and conditions and cycle sensibly in order to avoid any events that could cause damage to you, the Bike or any third party or any property owned by a third party.

10.1 If you are involved in an accident or damage or injury is caused to someone or something while using a Bike, you must:
a) Stop cycling when safe to do so; and 
b) email us at info@easit.org.uk to notify us of the accident and any resulting damage to the Bike. 

11. We reserve the right to amend these terms and conditions including the Charges at any time but, where practicable, will use all reasonable endeavours to provide you with prior notification of any such amendments.

11.1 You have the right to cancel this Payment Agreement at any time by contacting info@easit.org.uk and cancelling your registration to Cycle Hire, provided there are no outstanding Charges which are payable by you under these terms and conditions.

11.2 We reserve the right to suspend or cancel this Payment Agreement at any time and will use all reasonable endeavours to provide Registered Users with prior notification of such action.

11.3 You are responsible for ensuring that any combination codes issued to you are kept secure.

11.3 In accordance with our Non-Return/Damage Policy, you may be liable for Charges resulting from your failure to keep combination codes secure.

Schedule of Charges

12. If you fail to return the bike within one hour or the End of the Bike Access Period a Non-Return Charge of £100 shall become due immediately.

12.1 if you fail to return a Bike at all due to theft or any other reason a Non-Return Charge of £800 shall become due immediately. 

12.2 If you damage a Bike and fail to notify us a Damage Charge of £100 shall become due immediately. 

12.3 We will exercise our rights under this paragraph 12 in accordance with the Non-Return/Damage Policy

Exclusion and suspension

13. If at any time you do not comply with these terms and conditions and/or any applicable laws or fail to have due regard to the Tips for Safer Cycling while using a Bike, we reserve the right to exclude or suspend you from using Cycle Hire Scheme in accordance with the User Policy.

14. Information obtained by the police regarding non-compliance with these terms and conditions, any applicable laws and/or the Tips for Safer Cycling while you are using a Bike may be disclosed to us and we may use such information to exclude or suspend you from using Cycle Hire Scheme.
Other information

15. Only you and we have rights under these terms and conditions. No other person shall have any rights under these terms and conditions.

15.1 You may not transfer any of your rights under these terms and conditions to any other person.

 

Cycling safety tips

·       Visual Check.  Check the bike for any damage, i.e., punctures, missing reflectors, brake failure etc. 

·       Stop at red lights. It is illegal to jump red lights. You may be fined £50

·       Stay central on narrow roads. Try to ride away from the gutter. If the road is too narrow for vehicles to pass you safely, it might be safer to ride towards the middle of the lane to prevent dangerous overtaking by other vehicles

·       Stay away from parked cars. Ideally, keep a door's width away in case the door opens suddenly. Also, try to ride in a straight line past parked cars rather than dodging between them

·       Stay back from HGVs. Lorries and other large vehicles might not be able to see you clearly, so stay well back behind them

·       Always pay attention. Stay focused on what's going on around you so you can see what other road users might do

·       Make eye contact. Try to make eye contact with drivers so you're sure that they have seen you

·       Don't pavement cycle. It is illegal to cycle on the pavement or up a one-way street (unless clearly marked for cyclists)

·       Wear bright clothes. Consider wearing bright clothes during the day and reflective clothing/accessories at night

·       Night lights. There is a legal obligation to use lights after dark - white at the front and red at the rear. You may be fined £50 if you don't have them

·       Reflectors. Your bike must also be fitted with a red rear reflector, and amber pedal reflectors if it's manufactured after 1985

·       Signal. Use appropriate hand signals to indicate that you're turning left or right

·       No phones or devices. Don't use a mobile phone or earphones

 

·       Helmet. Consider wearing a helmet
